Terms, Policies & Customer Agreement
1. Payment Agreement
The Customer agrees to the total balance due by:
Depositing 60% of the total project cost before the project start date. No work will commence until the deposit is received.
Paying the remaining balance upon substantial project completion (operational and functional, excluding minor punch list items), unless otherwise stated on the invoice.
For larger projects, progress payments may be required, as outlined in the invoice or contract.
All payments must be made according to the agreed-upon schedule.
Late Payments:
Payments not received by the due date will incur a 1.5% monthly late fee (or the maximum allowed by law).
Interest charges or collection fees may also apply.
Failure to pay outstanding balances may result in:
Work stoppage.
Collection efforts.
Legal action.
2. Change Orders
Any changes or modifications to the original scope of work must be:
Submitted in a written change order.
Signed and approved by both parties before proceeding.
Paid in full before the change order work begins.
Change orders may extend the project timeline and increase the total project cost.
3. Unforeseen Conditions
If unforeseen conditions arise during the project (e.g., hidden damage, mold, structural issues, faulty wiring or plumbing complications), the customer will be:
Notified immediately.
Required to approve a change order before work continues.
Delays caused by unforeseen conditions may result in:
Additional labor and material costs.
Extensions to the project timeline.
4. Scope of Work
This agreement covers only the specific services, materials, and tasks outlined in the main contract.
Any work beyond the original agreement requires a separate estimate and approval.
5. Delays and Extensions
Concept Craft is not liable for delays caused by:
Weather conditions.
Supply chain issues.
Third-party subcontractor delays.
Timeline extensions will be communicated in writing.
6. Customer Responsibilities
The customer agrees to:
Provide property access during regular business hours for the duration of the project.
Ensure clear paths and accessible areas for deliveries (e.g., garage or open room).
Be present or provide access for the entire day of delivery.
If access is unavailable, re-delivery fees may apply.
Obstructions or delays caused by the customer may result in:
Additional charges.
Timeline adjustments.
7. Warranty and Liability
Concept Craft offers a two-year workmanship warranty covering installation defects only.
The warranty does not cover:
Damage caused by misuse, neglect, or modifications by other parties.
Normal wear and tear.
Material defects—handled directly with the manufacturer.
Repairs outside the warranty will be billed at the current service rate.
8. Pre-Lien Notice
For projects exceeding $2,000, Concept Craft reserves the right to file a preliminary lien notice under Arizona law.
This is a standard legal formality to protect both parties and ensure proper payment procedures.
Customers who intend to pay in full should not be concerned—the pre-lien does not indicate non-payment issues.
Upon full payment, the pre-lien is automatically nullified, and a lien release will be issued if necessary.
9. Termination and Cancellation
Either party may terminate the agreement with a 7-day written notice.
The customer is responsible for payment of all completed work, including ordered materials.
Deposits are non-refundable unless otherwise stated.
10. Material Disclaimer & Risk Acknowledgment
Countertops, Tile, and Like Materials:
All materials, including but not limited to quartz, natural stone, sintered stone, tile, and wood products, may contain inherent characteristics such as fissures, pits, veining, color inconsistencies, and internal stress. These natural or manufactured variations are not considered defects.
Due to these properties, materials may behave unpredictably during fabrication, transportation, or installation, potentially leading to cracking, breakage, or other issues. Any associated costs — including replacement materials or labor not covered by the supplier — are the sole responsibility of the customer.
Sintered and quartz products may also exhibit unpredictable behavior due to manufacturing inconsistencies that can contribute to these risks.
Additionally, exposure to light, heat, or natural aging over time may alter the appearance of the material. These changes are considered normal and are not grounds for replacement.
The customer should inspect materials before purchase and installation, if possible, to identify any visible defects or issues. Any materials found to be defective should be addressed directly with the manufacturer.
Cabinets & Wood Products:
Wood products, including cabinets, flooring, and other wood-based materials, may expand, contract, or develop hairline cracks due to humidity and temperature changes. These natural movements are to be expected and are not considered defects. Variations in grain, texture, color, or finish are inherent to natural wood and are not considered defects.
Additionally, natural aging and exposure to light can cause color changes over time, which are also not considered defects.
By approving the material and proceeding with fabrication or installation, the customer acknowledges and accepts these risks.
11. General Remodeling and Demo Disclaimer
Concept Craft is not responsible for issues arising from:
Pre-existing conditions (e.g., outdated systems, hidden damage).
Cosmetic or incidental damage to adjacent surfaces, fixtures, or finishes during demolition and/or installation unless specifically stated in the contract.
Any required touch-ups or repairs will be billed separately unless noted in the contract.
12. Dust Notice
Customers are advised to:
Remove or cover valuables, electronics, and sensitive items during the project.
Understand that with the nature of remodeling work, some dust is unavoidable, despite best efforts to contain it.
Understand that dust may linger even after cleaning.
Professional cleaning services post-project are recommended and can be provided at an additional cost.
13. Visual Aid Disclaimer
All design renderings are visual aids and not exact representations.
Final measurements must be confirmed in the field.
Actual items may vary from renderings.
Handles, shelves, decorations, and appliances are not included unless explicitly stated in the estimate or invoice.
14. Agreement
By accepting the estimate, proposal, or invoice, the customer agrees to these terms and conditions.
By depositing any payment, the customer acknowledges that they have:
Read, understand, and agree to the terms and conditions in full.
The deposit serves as confirmation of their agreement to proceed.
